This Privacy Policy explains how Zelyth, a brand operated by YTS Commerce, collects, uses, stores and shares personal data when you visit zelyth.com, create an account, place an order, contact us or otherwise interact with our services.

We believe privacy information should be clear and understandable. This policy therefore describes not only what information may be processed, but also why it is needed and the choices and rights available to you.

Who we are

Zelyth is a brand operated by YTS Commerce, a business established in Belgium.

Controller: YTS Commerce
Brand: Zelyth
Registered office: Minister Delbekelaan 54, 2170 Merksem, Belgium
Enterprise number: 1013.642.278
Website: zelyth.com
Privacy contact: [PRIVACY EMAIL TO BE ADDED]

The registered office above is our official business address and is not a visiting or returns address. Please do not send products or unsolicited correspondence to this address unless we have specifically instructed you to do so.

For the personal data processed in connection with Zelyth, YTS Commerce generally acts as the data controller. This means that we determine why and how your personal data is processed.

Information we collect

The personal data we process depends on how you interact with Zelyth. We only seek to collect information that is reasonably necessary for the relevant purpose.

This may include:

  • Identification and contact information, such as your name, email address, telephone number, billing address and delivery address.
  • Order information, including products ordered, order value, order status, delivery information, returns, refunds and previous purchases.
  • Account information, including your account details, saved addresses and order history.
  • Payment-related information, such as payment status, payment method and transaction identifiers. Complete payment card details are processed by our payment service providers rather than stored directly by Zelyth.
  • Communications, including information you provide when contacting us through a contact form, email or another support channel.
  • Technical and device information, such as IP address, browser type, device information, operating system, approximate location derived from technical information, website activity and server logs.
  • Marketing information, including newsletter subscriptions, marketing preferences and interactions with marketing communications where these services are enabled.
  • Analytics and advertising information, including information generated through cookies, pixels and similar technologies where permitted and, where required, after you have provided consent.

Please do not provide sensitive personal data through our website or customer service channels unless it is genuinely necessary in connection with your request.

How we use your information

We may process personal data to:

  • process, confirm and manage your orders;
  • arrange payment, fulfilment, delivery, returns and refunds;
  • create and maintain your customer account;
  • respond to questions, requests and customer service enquiries;
  • send transactional communications relating to your orders or account;
  • maintain the security and proper functioning of our website;
  • detect, investigate and help prevent fraud, abuse and security incidents;
  • comply with accounting, tax and other legal obligations;
  • understand how our website and services are used;
  • improve our website, products, customer experience and services;
  • measure advertising and marketing performance where permitted;
  • send marketing communications where you have subscribed or where another lawful basis permits us to do so; and
  • establish, exercise or defend legal claims where necessary.

Legal bases for processing

We process personal data only where there is an appropriate legal basis for doing so. Depending on the circumstances, we rely on one or more of the following legal bases.

Performance of a contract

Certain processing is necessary to enter into or perform our contract with you. For example, we need your name, delivery details and relevant order information to process and deliver an order.

Legal obligations

We may process and retain certain information where this is necessary to comply with obligations imposed on us by Belgian or other applicable law, including accounting, taxation, consumer protection and record-keeping requirements.

Legitimate interests

We may process information where this is necessary for our legitimate business interests and those interests are not overridden by your rights and freedoms. These interests may include protecting our website and business, preventing fraud, handling disputes, improving our services and maintaining appropriate business records.

Consent

Where required, we rely on your consent, particularly for certain marketing activities and non-essential cookies or tracking technologies. Where processing is based on consent, you may withdraw that consent at any time. Withdrawal does not affect the lawfulness of processing that took place before consent was withdrawn.

Orders and payments

When you place an order, we process the information necessary to accept your order, receive payment, arrange fulfilment and delivery, provide customer service and administer any return or refund.

Payments are processed through WooPayments and its payment infrastructure and payment partners. Depending on your location, device and the payment methods enabled at the time of checkout, available payment methods may include payment cards, digital wallets and local or deferred payment methods.

Payment service providers may independently process information necessary to authorise transactions, prevent fraud, comply with financial regulations, process refunds or chargebacks and provide their payment services. Their processing may also be subject to their own privacy information.

Zelyth does not need to receive or store your complete payment card number in order to operate the webshop. We may nevertheless receive information such as payment status, payment method, transaction reference and limited payment-related details required to administer your order.

Fulfilment and delivery

Zelyth uses fulfilment and logistics partners to prepare and deliver orders. Where necessary to fulfil your purchase, relevant personal data may be shared with our EU-based fulfilment and logistics partners.

This may include your name, delivery address, contact details, order contents and other information reasonably required to prepare and deliver your parcel.

Depending on the destination and shipment, delivery may be performed by carriers such as GLS, DPD or Packeta. The carrier used for a particular order may vary according to the destination and available delivery network.

Our current delivery service is home delivery. Carriers may process delivery information according to their own legal obligations and privacy practices when providing their services.

Your Zelyth account

If you create a customer account, we process the information necessary to provide and maintain that account. This may include your contact details, saved addresses, account credentials and order history.

You are responsible for keeping your account credentials confidential. If you believe somebody has gained unauthorised access to your account, please contact us.

Marketing communications

Where available, you may choose to subscribe to Zelyth marketing communications. These may include product news, editorial content, launches, offers and other updates from Zelyth.

We may use a specialist email marketing provider, such as Klaviyo, to manage subscriptions and deliver marketing communications. In that context, information such as your email address, subscription status and interactions with our communications may be processed.

You can unsubscribe from email marketing at any time using the unsubscribe option included in our marketing emails. Unsubscribing from marketing does not prevent us from sending essential transactional communications, such as order confirmations, delivery information or messages relating to your account.

Zelyth does not currently use SMS marketing.

Analytics and advertising

We may use analytics and advertising technologies to understand website performance, measure how visitors interact with Zelyth and evaluate our marketing activities.

These services may include Google Analytics and the Meta Pixel. Depending on your consent choices, these technologies may process information such as device identifiers, browser information, IP-derived information, pages viewed, interactions, referral information and information relating to purchases or other website events.

Where consent is legally required for analytics or advertising technologies, these technologies should only be activated after the relevant consent has been provided.

You can review or change your cookie choices through the cookie preferences available on our website. More detailed information about the technologies used by Zelyth will be provided in our Cookie Policy.

Cookies and similar technologies

Zelyth uses cookies and similar technologies for purposes such as operating the website, maintaining shopping cart and checkout functionality, remembering preferences, securing the website and, subject to your choices, analytics and advertising.

Some technologies are necessary for the website or a service you request to function and cannot always be disabled through our consent controls. Non-essential analytics and advertising technologies are handled according to the consent requirements applicable to them.

Please see our Cookie Policy and Cookie Preferences for further information and available controls.

Who we share information with

We do not sell your personal data. We may disclose or make personal data available to third parties where this is necessary to operate Zelyth, provide our services or meet our legal obligations.

Recipients may include:

  • website and hosting providers, including infrastructure used to operate our WordPress and WooCommerce website;
  • payment service providers involved in processing payments, refunds, fraud prevention and payment disputes;
  • fulfilment and logistics partners responsible for preparing and dispatching orders;
  • delivery carriers, including GLS, DPD and Packeta where applicable;
  • marketing and email service providers, such as Klaviyo where enabled;
  • analytics and advertising providers, including Google and Meta where the relevant services and consent choices apply;
  • website service providers supporting functions such as contact forms, security, backups and technical maintenance;
  • professional advisers, such as accountants, legal advisers or other professional service providers where necessary; and
  • public authorities or other parties where disclosure is required by law or necessary to establish, exercise or defend legal rights.

Our website is hosted using Namecheap infrastructure. Our ecommerce environment is based on WordPress and WooCommerce. These and other technology providers may process technical or operational data as necessary to provide their services.

International data transfers

Zelyth is operated from Belgium and our order fulfilment is arranged through EU-based fulfilment infrastructure. However, some technology, payment, analytics, advertising and marketing providers we use may operate internationally or process information from locations outside the European Economic Area.

Where personal data is transferred outside the European Economic Area and the destination does not benefit from an applicable adequacy decision, we require an appropriate transfer mechanism or other legally recognised safeguard where required. Depending on the provider and circumstances, this may include approved contractual safeguards.

How long we keep information

We do not intend to retain personal data for longer than reasonably necessary for the purposes for which it was collected.

The applicable retention period depends on the type of information, the reason it is processed and any legal obligations that apply. In determining retention periods, we consider factors such as the duration of our customer relationship, accounting and tax requirements, warranty and consumer obligations, fraud prevention, security requirements and applicable limitation periods.

Order, transaction and invoicing information may therefore be retained for the period required under applicable accounting, tax and commercial law. Customer service and dispute-related information may be retained for as long as reasonably necessary to resolve the matter and protect legal rights.

Account information is generally retained while your account remains active and may subsequently be retained where necessary for legitimate record-keeping or legal obligations. Marketing information is retained until you unsubscribe or until it is no longer reasonably necessary, subject to limited records that may be retained to ensure that an opt-out continues to be respected.

Technical, security, analytics and cookie-related information may have different retention periods depending on the relevant system or service.

Security

We use appropriate technical and organisational measures intended to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure or access.

These measures may include access controls, secure connections, account authentication, software maintenance, payment security measures, backups and limiting access to personal information according to operational need.

No website, transmission method or storage system can be guaranteed to be completely secure. We therefore continuously treat data security as an operational responsibility rather than representing that any system is risk-free.

Your privacy rights

Subject to the conditions and limitations provided by applicable data protection law, you may have the right to:

  • request access to personal data we hold about you;
  • request correction of inaccurate or incomplete personal data;
  • request deletion of personal data in circumstances where the right to erasure applies;
  • request restriction of certain processing;
  • object to certain processing, including processing based on legitimate interests in appropriate circumstances;
  • receive certain personal data in a structured, commonly used and machine-readable format where the right to data portability applies;
  • withdraw consent where processing is based on consent; and
  • object to direct marketing at any time.

These rights are not absolute. For example, we may need to retain certain information despite a deletion request where retention is required by law or necessary for the establishment, exercise or defence of legal claims.

To exercise a privacy right, contact us at [PRIVACY EMAIL TO BE ADDED]. We may request information reasonably necessary to verify your identity before acting on a request, particularly where disclosure of personal information is involved.

Children

Zelyth is a general ecommerce website and is not specifically directed at children. Our products are not presented as adult-only products and we do not perform general age verification merely for access to the website.

We do not knowingly seek to collect personal data from children through services intended specifically for them. Parents and guardians remain responsible for supervising a child’s use of online services and purchases where appropriate.

Automated decision-making

Zelyth does not currently use solely automated decision-making that produces legal effects concerning you or similarly significantly affects you.

Certain service providers, particularly payment and fraud-prevention providers, may use automated systems as part of their own security, risk assessment or fraud-prevention processes. Where applicable, those providers may provide additional information about their processing in their own privacy documentation.

Changes to this Privacy Policy

We may update this Privacy Policy when our services, technologies, suppliers or legal obligations change.

The date and time displayed at the top of this page indicate when this Privacy Policy was most recently updated. Where a change materially affects how we process personal data, we will take additional steps to inform affected individuals where required.
